These Terms of Use set out the rules for using the Cybersee website, Cybersee Labs and the Cybersee platform.
1. Acceptance of these Terms
These Terms of Use govern access to and use of the Cybersee website, Cybersee Labs, the Cybersee platform, dashboards, APIs, reports, content and related services (the "Services"). By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
2. About Cybersee
The Services are provided by Smart Surveillance for Cybersecurity Company (شركة الرقابة الذكية للأمن السيبراني), trading as Cybersee, Commercial Registration No. 1009081639, Riyadh, Kingdom of Saudi Arabia. Cybersee provides digital risk protection, including dark web intelligence, brand protection, attack surface monitoring and takedown services.
Paid Services are also governed by a separate agreement, order form or statement of work. If it conflicts with these Terms, the signed agreement prevails for the Services it covers.
3. Use of the Services
We grant you a limited, revocable, non-exclusive and non-transferable right to use the Services for lawful business and security purposes, in line with these Terms, applicable law and any documentation we provide.
4. Cybersee Labs free scans
- You may only scan domains that your organisation owns or is authorised to assess.
- Results are provided free of charge, for information only, and may be incomplete. Detailed results are shown only to users with a work email on the scanned domain.
- Scans are passive and use public and underground sources. They do not test or access your systems.
- We may limit, suspend or withdraw Cybersee Labs at any time, and may apply rate limits to prevent abuse.
5. Accounts and access
You must provide accurate information, keep your credentials confidential, and notify us promptly of any suspected unauthorised access. You are responsible for activity under your account. We may suspend access that we reasonably believe is compromised or misused.
6. Acceptable use
You must not:
- use the Services for unlawful, fraudulent, harmful or unauthorised purposes;
- attempt to gain unauthorised access to our systems, accounts, infrastructure or APIs;
- disrupt, overload, scan, probe or test the Services without our written permission;
- reverse engineer, copy, resell or commercially exploit the Services unless expressly allowed;
- use our content or brand to create misleading, phishing or impersonating material;
- upload malware, exploits, spam or other harmful content;
- submit false information or impersonate any person or organisation.
We may investigate suspected misuse and take appropriate action, including restricting access and reporting to competent authorities where required.
7. Intellectual property
The Services and all related software, designs, reports, research, text, logos and trademarks belong to Cybersee or its licensors. These Terms do not transfer any ownership to you. You may not copy, republish, scrape or create derivative works from our content without written permission, except brief excerpts with clear credit and a link to the source.
8. Your data and submitted materials
You confirm that you have the right to submit any data, domains, evidence or other materials you provide through the Services. You keep ownership of your data and grant us the rights needed to process it to deliver the Services, including takedown and investigation activities. Personal data is handled in accordance with our Privacy Policy.
9. Confidentiality
Security findings, reports, incident details and other non-public information exchanged through the Services are confidential. Each party will use the other’s confidential information only for the purpose of the Services and will not disclose it except as authorised or required by law.
10. Security information disclaimer
Alerts, reports, indicators and findings support awareness and decision-making. We do not guarantee that every threat, exposure or impersonation will be detected, reported or removed. You remain responsible for your own security decisions, validation and remediation. Nothing in the Services is legal, regulatory or financial advice.
11. Availability
We aim to provide reliable Services but do not guarantee they will be uninterrupted or error-free. We may update, suspend or discontinue parts of the Services for maintenance, security, legal or business reasons. Service levels for paid Services are set out in your agreement.
12. Limitation of liability
To the maximum extent permitted by the laws of the Kingdom of Saudi Arabia, Cybersee is not liable for indirect, incidental, special or consequential damages, including loss of profits, data, revenue or goodwill, arising from use of the Services. Where a signed agreement applies, its liability terms govern.
13. Indemnification
You agree to indemnify Cybersee against claims, losses and costs arising from your misuse of the Services, your breach of these Terms, or your infringement of third-party rights.
14. Suspension and termination
We may suspend or terminate access if you breach these Terms, create a security risk or misuse the Services. You may stop using the free Services at any time. Termination of paid Services is governed by your agreement.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Continued use of the Services after changes are published means you accept them.
16. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes arising from them are subject to the exclusive jurisdiction of the competent courts in Riyadh, unless a signed agreement provides otherwise. If these Terms are provided in Arabic and English, the Arabic version prevails in case of conflict.
